Expungement does not clear the internet

Expungement clears or seals the official record but does not automatically remove copies already published by news sites, mugshot networks and data brokers. Many states now require commercial republishers to remove on proof of expungement, and that documentation is the most powerful tool you will have, so the online work should start the day the order is granted.

What expungement does and does not reach

It reaches the official record held by courts and agencies. It generally does not reach a private website that copied the information while it was lawfully public, because that copy is not the record.

People are frequently surprised by this, having assumed the process ends at the courthouse. In practice the courthouse is where the second phase becomes possible.

The order is not the finish line. It is the credential that makes the next part work.

Use the order as documentation

  • Many states now require mugshot and record sites to remove content on presentation of proof of expungement, often within a defined period and without charge.
  • Data brokers and background-check providers are subject to accuracy obligations and generally act on a court order promptly.
  • News outlets are not obliged to act, but a significant number will append an update or unpublish for a non-public figure where the case was cleared.
  • Search engines will consider de-indexing where a legal basis is documented.

Sequence and timing

Start the online work immediately after the order. Copies keep propagating while you wait, and each new copy is another removal target.
